Thanks to Dave Toney for the audio from the We the People Foundation opposing view press conference today. Bob Schulz, Jonathan Turner, Sherry Jackson and Joe Banister held their own press conference outside the Treasury Department Headquarters, as the IRS released this press release.

Wednesday morning, the Oakland Cannabis Buyers Club will be heard by the 9th Circuit federal court regarding the (un)constitutionality of the federal government pursuing medical marijuana patients within the State of California even though Californians overwhelmingly passed Proposition 215, "The Medical Marijuana Initiative". From my understanding of the limited powers granted to the federal government in The Constitution, I ask, how does a person growing marijuana in the City of Oakland, for use withing the City of Oakland, by another resident of the City of Oakland, with the cosent of the City Council of the City of Oakland fall under the inter-state commerce clause?

The 9th Circuit, the most overturned court in history, has again set themselves up for another spanking by the Supreme Court in ruling that 6 California counties using punch card ballots for the coming recall election amounts to a violation of the "equal protection" clause of the 14th Amendment. According to the Daniel Weintraub blog, the Secretary of State will appeal to the Supreme Court.

Secretary of State Kevin Shelley says he will announce at 2 p.m. Tuesday his position on the Ninth Circuit ruling and, presumably, whether the state should appeal. He also issued a short memo to the counties instructing them to keep moving toward an Oct. 7 election and asking them to encourage voters to act as if the election will be held on that date.
As a resident of one of the six counties, let me publicly state that I much prefer the paper punch ballots to the unverifiable electronic voting machines currently being touted. They're focusing on the wrong ballot type if the concern is to guarranty the franchise.
